Attachment of real property gives you security in the debtor's property, registered in the Danish land register — and a place in the queue when it is sold.
In practice
If the debtor owns real property, an attachment there is often the strongest security you can obtain. The attachment is registered in the land register and follows the property: it cannot be sold or mortgaged free of your claim.
But priority decides everything. The mortgage credit loan ranks first, the bank next, and after them come the creditors who have obtained attachments — in the order they arrived. If the property is mortgaged to the hilt, an attachment at the back of the queue is worth nothing.
Where it commonly goes wrong
- Waiting. Priority is decided by who got there first. Every month you wait can cost you a place in the queue.
